More than 40 years of Atlanta-based tax law practice characterize John Tyler & Associates, LLC, led by John P. Tyler, who holds dual credentials as a licensed attorney and certified public accountant. Tyler serves as Counsel in the Tax Practice of Smith, Gambrell & Russell, LLP, and concentrates on federal income tax planning, tax controversy, and federal energy tax credits.
Tyler’s academic background includes a B.A. in Economics from Bucknell University (1968) and a J.D. from Emory University School of Law (1973), where he earned American Jurisprudence awards in Corporate Taxation, Taxation of Corporate Reorganizations, and Trial Practice. His career has spanned work at Arthur Andersen & Co., the Carter-Mondale Presidential Campaign as Assistant Controller, and service at the IRS Regional and District Counsel office, where he represented the government in U.S. Tax Court and handled criminal tax matters.
The firm’s litigation record is extensive. Tyler has successfully litigated more than 200 cases in United States Tax Court, as well as cases in District Courts and Federal Courts of Appeal. Two landmark decisions bear his involvement: American Boat Company v. U.S., cited over 100 times for the reasonable cause defense in tax shelter penalty cases, and Penrod v. Commissioner, cited over 500 times for the continuity of interest doctrine in tax reorganizations.
Notable outcomes published on the firm’s website include settling a $9.4 million estate valuation dispute for approximately $300,000, and resolving a case with more than $9 billion in IRS assertions for a refund exceeding $50,000. Tyler holds an AV Preeminent rating from Martindale-Hubbell and is a member of the American Bar Association Tax Section and the American Institute of Certified Public Accountants.
